GOVERNMENT'S BUSINESS: RIGHT TO KNOW

An opinion piece in the Lincoln-Times News Public’s Business Belongs in Public  they say this about violating public record law and the duty of city officials to be open and to follow the law:

North Carolina law and common sense regarding the function of a democratic society require that discussions by our elected officials, even the Lincolnton City Council, be conducted in open session.

A few exceptions — we would say too many — are allowed under North Carolina law. Even so, in no case do those exceptions ever include taking action in closed session. Yet the City Council erred twice in this regard during last week’s meeting.

Certain issues can be discussed in closed session. But statutes are clear in requiring that actions, even regarding matters that can be discussed away from the eyes and the ears of the people, be taken in open session for all to see. Board members must stand up and be counted. To do otherwise is an offense against the citizens who have a right to know what their government is up to, so that they can vote more intelligently.

The City Council acted inappropriately in voting on City Manager Jeff Emory’s contract during closed session, though it’s not clear that members had any improper intent. Regardless, we urge the city to redress this situation by issuing a statement to local news media explaining the breakdown of votes.

The second error in acting during closed session is far more serious because it also appears to be an effort to silence critics.

The law requires that the members specify which exceptions to open meetings laws are being applied when they go into closed session. It’s not enough to close the meeting, saying they’re going to discuss Emory’s contract, and then do whatever else they want.

But whatever the council does, it needs to be done where everyone can see it. Let’s conduct the public’s business in public.

Charlotte has a problem with conducting the public’s business in public.  If that weren’t the case, they would give records answering what the City and the CMPD are doing. 


COUPLE MILLION DOLLARS OF MISSING POLICE CARS
The Mayor and Council members should be asking questions.  Mayor Foxx was with the entire City Council on October 10th when Deputy Police Chief Katrina Graue stood before them and explained that they couldn’t find 50 brand new police cars.  They proceeded to vote to approve another $5 million to buy more police cars, after Graue had finished explaining much of that money would go toward buying cars the Police Department didn’t want to buy.

If Graue was truthful about being unable to locate 50 police cars, that would be a huge security risk.  Nobody seems to care, including City Manager Curt Walton and Police Chief Rodney Monroe.  Monroe is charged with securing the city when Democrats and our President come to town in less than a year.  At this point, the option that they are covering up where those cars really are would be preferable to “unaccounted for.”  Based on history and information from other personnel, it seems more likely that those cars are being driven by people who shouldn’t be driving them.  At the rates Graue stated, this would be about $1,000,000 base price for the cars (minimum) plus almost another million dollars or so to install police equipment.

PRIOR RELATIONSHIPS WITH VENDORSThis equipment would include a computer system that most patrol officers say isn’t useable or at least useful because it takes up to half an hour to boot up.  So laptops in cars are primarily used for emails, checking warrants, and writing reports.  The system was purchased after Chief Rodney Monroe spoke to City Council and explained that he believed the so-called predictive analysis would be the wave of the future and should be explored.  He wanted to explore that as well as look for funding.  But it turns out Monroe had already explored thoroughly in his last job.   The contract for very complicated software to combine thirteen different data source systems and produce a utility for CMPD officers went to a company he did business with in Richmond, VA as Police Chief after only a few months of searching for vendors and processing RFP's.   Monroe had a prior relationship with the contract winner.

The contract worth millions was given to Information Builders.  Chief Monroe has participated in print ads, video promotions, and on-line promotions for this company—as CMPD Chief.  He did the same as Richmond’s Police Chief, so there seems to be no viable reason he didn’t bring this up when he was asking Council for more of our money to go to a company he has done business with. 

Again, Walton, Foxx, and City Council have done nothing publicly to investigate this troubling set of circumstances.



MONROE’S BACKGROUND
Back when he was planning to come here to be Police Chief, Monroe spokewith Tom Roussey.

Monroe says he believes strongly in not running a secretive police department. He wants to be transparent and build relationships with the public.

"The better you improve upon your ability to impart information, the greater your chances are of obtaining information," he explained.

But Monroe has used his staff (paid by Charlotte’s citizens) to insulate himself from answering questions and denied the public access to information that belongs to the public.  And he continues to be supported in this by Walton and the rest.

Either Walton, Council, and the Mayor didn’t get our money’s worth on Monroe’s background check, or they knew everything and hired him anyway. 


OFFICER MISCONDUCT, CRIMES, AND
Since then, the department has been in trouble for a long list of reasons, including hiring Marcus Jackson as police officer even though he had two prior restraining orders, one denoting he was not permitted to use a gun.  He was retained as a police officer even though he had two reprimands for lying on reports.  Some have asked whether Monroe intervened to keep him on the force.  Monroe first stated he only knew about one disciplinary action.  Then the documents showed up proving he had been notified of at least two, prior to his statement. 

City taxpayers have had to pay millions already over the sexual assaults committed by this officer hired with a history of trouble against women.  Jackson was convicted of his crimes, but got off with what many consider a light sentence for a uniformed police officer who tracked down susceptible people to assault, such as a teenager and Hispanic people whom he may have thought vulnerable.


RECORDS “LOST?”
All of the bad information coming out of CMPD and the efforts to keep public information secret cause questions about what happened at the CMPD Training Academy.  CMPD attorneys first denied, then partially admitted there was an investigation by the State agency within the Department of Justice to find out what happened to purportedly hundreds of officers’ records from the Academy.  They have refused to say how many, but fingerprint cards, medical records, and other police records have been “discovered missing.”  Monroe’s people and City politicians won’t tell when they were last known to be intact, either. 

Monroe must be wishing all the records were “lost” before any number of lawsuits he has been named in. 

In order to investigate his own department regarding this problem with missing police records, Monroe reportedly hired recently-retired CMPD officer Gary McFadden, his close associate for the job. 

Everyone knows government agencies don’t have a good track record of investigating themselves.  This should be done by personnel with NO association to Monroe or CMPD.

Again, City politicians seem to have zero interested in this security risk, this threat to officers’ certifications, and this display of incompetent record security. 


TASER RECORDS
First, the CMPD refused to explain the contract irregularities involved in the TASER deal.

Next, the $2 million worth of TASERS which were supposed to be “safer” because of a five-second time limit per shot were shipped to CMPD.  The brand new TASERS don’t work properly, so they are still not being distributed.  Deputy Chief Graue tried to put a good face on things, though, saying the new TASERS needed a “software upgrade” instead of admitting they don’t function as specified contract that came about with questionable timing.

City Council voted to approve the TASER purchase after TASER, Inc. threw a luncheon and all-day meeting for CMPD Brass to train them on legal issues, dealing with the press, and more.

Maybe they were preparing for this shipment of TASERS that doesn’t function properly.


TOTAL SUPPORT
All the while, Monroe has received unquestioned support from local politicos who often trumpet the drop in reported crime rates.  This reported drop has happened since Monroe removed all public access to the real crime information and won’t reinstate it.

PROMOTIONS TO LIEUTENANT IN THE MIDDLE OF LAWSUIT

Rodney Monroe has promoted (at least it’s being called a promotion) the following Charlotte Mecklenburg  Police officers to the rank of Lieutenant.

This is another position not created in the CMPD Directives, which are supposed to govern every action taken by CMPD officers, including Rodney Monroe.

RAC Sergeants (many of whom are now-former-RAC Sergeants and included on the list below) have been the subject of much controversy of late because Monroe and the Department, and the City of Charlotte have made their position in recent court proceedings that the RAC Sergeant position never really existed and was a temporary position in name only.   The Position of RAC Sergeant was never in the Directives, and other positions in the past were never included in the Directives.

A judge ruled against rationales put forth by Monroe and the City last week, in favor of Sgt. Tammy Hatley, ruling in part that Hatley had been denied due process because she was in fact demoted from a postion to which she had been promoted in 2008 and without the due process afforded her according to CMPD Directives.  The judge ordered a jury to decide damages.  Reports are that the case has moved to settlement discussions.

This seems like a very strange time to put out a statement promoting people to another rank not established.  And here’s another case of putting off a promotion ceremony with no expected date.  Last time it took months.  Why?  And is there more to come this round?

Here's How the NEW $1.82 Million TASERS Don't Function Properly

citynewswatch has received a memo sent from CMPD regarding the malfunctioning TASERS we just bought for at least $1.8 Million dollars.  These TASERS were supposed to be in use by now.  They were supposed to replace the last TASERS which were perfectly useable and no more unsafe than the sales pitch for the new TASERS except that you had to take your finger off the trigger and stop TASING someone after a few seconds on your own, instead of having software that does it for you.

Now it is known that the so-called safety feature limiting the time an officer can shoot someone with the TASER 15,000 volts is not functioning properly, and there will have to be a “software upgrade.”

FROM DEPUTY CHIEF KATRINA GRAUE:

The Charlotte-Mecklenburg Police Department continues to move forward with TASER X2 training to issue the new electronic control weapon to our officers.    The department  is constantly  reviewing  upgrades to the TASER X2 to satisfy the CMPD’s requirements that the deployment cycle is limited to five seconds for the probes and the Arc Switch.    The CMPD requested TASER International upgrade the software in the CMPD TASER X2 to limit the Arc Switch to five seconds.

The software upgrade does not impact classroom instruction on the electronic control weapon, policies and procedures for more than 1,700 CMPD officers.  The training is scheduled to be completed by the end of 2011 and the TASER X2 will be distributed to our officers when the software is upgraded.

With the current software problem, the user can push a button to cause an arc of electricity without removing the TASER cartridge as you had to do before with the X-26 model TASER (you could still do what is called a “drive stun” with the cartridge in place if you wanted to). 

The arc would be used for a daily functionality test of the TASER and as a warning to a suspect or as a compliance technique. The arc was supposed to only last 5 seconds but now it is found that it would continue as long as one held the trigger. 

There goes the main stated purpose for spending $1.82 million tax dollars with a company that uses the Charlotte-Mecklenburg Police Department sale to advertise the new X-2 model…

Note there is no timetable on fixing the faulty TASERS, just a vague assurance that the TASERS will be in use next year. 

No wonder the City and CMPD continue to refuse information about their contract associations and irregularities.  The public can’t get a straight answer about anything.

CMPD’s Fingerprints Are All Over This

A month-and-a-half since CedarPosts.blogspot.com broke the story of the missing Law Enforcement records at the Training Academy, and continuous public records requests refused by every level of CMPD and the City of Charlotte officials, one more piece of information is out:

Here is half of the memo demanding that some of the officers must go get their fingerprints re-submitted, or risk their certifications as law enforcement officers, as suggested in the last post on this topic by citynewswatch here.

 As you can read, CMPD lost or destroyed (to be determined) records of it's own Law Enforcement Officers, then sent this memo threatening that if they did not submit new documentation of their fingerprints, it could result in loss of their State Certification as LEO's.   What is the excuse for this kind of mismanagement?  How many other records are gone?  What repercussions have taken place, other than for the officers whose records are gone?  What investigation is underway to discover the source of the missing records?

I have found that a Department of Justice investigation and/or audit is either underway or completed referencing the below matter of officers' records missing from the Charlotte Mecklenburg Police Department. It has been brought to my attention that hundreds of current officers were forced to provide new fingerprint cards to put on record for the CMPD due to loss of original records. Please confirm this information. Also, how many fingerprint cards have been lost for now-former officers, and what determination has been made in handling their records which have been lost? Have they or will they be required or asked to supply fingerprints again? What would be the implications regarding any past or open crimes and comparison to fingerprints or other medical records? Are DNA samples an issue in the lost records?
I continue to wait for fulfillment of all public information requested herein and below and fully expect my public officials to comply with these requests, per public records law.

Missing Fingerprints, Medical Records, SSN’s, Police Cars, Unexplained Money… and this is the Police Department

DEPUTY CHIEF GRAUE ADMITS OFFICER RECORDS MISSING
Deputy Chief Katrina Graue, Administrative Services Group, sent out a most tortuously-written memo to all CMPD sworn employees on September 23rd, 2011 (note:year corrected from earlier post typo), carefully explaining the Charlotte-Mecklenburg Police Department Police Department was scheduled for its “first on-site audit from the North Carolina Criminal Justice Training and Standards Division” on September 26th.  citynewswatch has independently obtained a copy of the most unusually and carefully worded memo from DC Graue to all CMPD sworn employees.
She states that in “anticipation” of this audit, they went about gathering up documents.  Apparently some time directly proximate to this preparation for the audit, hundreds of personnel records of various description were acknowledged missing.  There has been no explanation for what prompted this “first-ever audit” or how it was discovered that at least some records are gone, but this letter and other known emails sent definitely indicate that is the case. 
Deputy Chief Graue went on with a long, tortured explanation of how there had been changes of documentation requirements in the past thirty years. 

Documentation requirement changes have absolutely nothing to do with losing hundreds of personal, identifying, security, documents which is clearly acknowledged in the paragraph that followed:

We have various checks and balances in place. While the specific form requested by the State may not be in the file, there are other documents that may satisfy the State’s requirement. For example, a fingerprint card completed at hiring may not be in the file, but there is a document showing a national criminal history was run on the applicant.  There may not be a medical report from a doctor.  However, there is documentation indicating the applicant was physically fit for employment as a police officer. We will not be able to determine what documentation is acceptable until the State arrives and completes their audit.   (emphasis added)

And this equally camouflaged statement:

CMPD maintains all our personnel are currently certified through the State and our officers continue to meet standards required by the state to maintain their state certifications.  (emphasis added)
Does this mean that even after numerous officers were forced to have their fingerprints redone because of the loss of records under this command staff, some may still be under threat of losing their certifications, their job security, benefits, and who knows what other repercussions?  When will the results of this audit be released?  What measures are being taken by Chief Monroe to clean up this security issue in his house, and to address the needs of his officers?  Is Curt Walton taking action for additional oversight in his position as City Manager?  What about Mayor Foxx and City Council in their oversight positions of Walton, all of whom continue to smile and say how they have such confidence in Chief Monroe’s ability and background?

Graue’s memo goes on to make this statement:

We want to assure our officers that no sensitive or personal information has been compromised in any way.    

How can you say there's no sensitive or personal information compromised in any way if fingerprints are missing (which is clearly indicated) and medical records are missing (also clearly indicated)?  There's no mention of SSN's, but who has ever filled out a medical form without giving a SSN, birth date, phone number, and address, in addition to possibly very sensitive medical background?  Also, fingerprints of an unknown number of officers are clearly missing, with unpredictable consequences.

Regardless of any other possible information that's missing, It's clear that at least SOME number of those two things are missing.

LOTS OF DENIAL
Emails forwarded to citynewswatch show the informed officials of the City that have refused requests made under public records law to find out what records are missing, how it was discovered, what agency is investigating, and more.  It looks like a good topic for upcoming investigation might be strictly public records law responses. 
They would not answer questions or give a copy of a known earlier email requiring at least some officers re-submit fingerprints for the academy files about a month ago.  Cedarposts.blogspot.com reported a records fail at the academy back on September 16th, and also a scathing letter issued by the Police Chief to a “main stream” reporter who dared to ask about a major security issue.  This is the same Chief who gives interview quotes he is at ease with running major national events, such as the Million Man March and two Presidential Inaugurations.  One might not think he’d get so bent out of shape with a simple press inquiry… unless it’s not that simple.
It’s a widely-known issue that CMPD Public Affairs will cut off information to reporters for the slightest slights… any issue that doesn’t fall in line with the image they want to promote.  Goals and Objectives of the City of Charlotte and of the CMPD are stated as “Increase Perception of Safety,” rather than to increase the actual safety.   
But it’s a rare event to have a personal email from the Chief himself warning you not to even ask about a story.  It should be shocking.  Imagine a reporter would ask about a story of importance to the community, and which we have a right to know about.   Media lists are regularly edited to remove those that are on another kind of list, if you know what I mean.

CRIMINAL JUSTICE COMMISSION INVESTIGATIVE UNIT
Among other things, program auditing involves conducting “on-site audits of agency files to ensure compliance with Commission rules.”  From DC Graue’s memo, this item seems to be very high on their list for coming to Charlotte’s Academy.  From the State’s DOJ website: questions or comments concerning the Commission's Investigative Unit, you may contact a staff members at the Criminal Justice Standards Division of the North Carolina Department of Justice.  For law enforcement inquiries, please contact Richard Squires at (919) 661-5980. 

INTERNAL OVERSIGHT AT CMPD
Should we be surprised that the Leadership at CMPD who stated they don’t know where 50 of their brand new police cars disappeared has “lost” a great deal of paperwork?   Probably not.  Almost nothing is surprising from this Police Chief or the City Management that supports him.

Could this have to do with potentially damaging personnel records needed for review in lawsuits coming up, such as the Marcus Jackson cases still dogging CMPD and Chief Monroe?   Monroe admitted responsibility and suits have so far cost huge amounts of money—a few hundred thousand here, a few hundred thousand there… it adds up. That doesn’t count the attorney’s fees.  Or the trauma to the women and men involved.  Or the damage done to the department or the trust in the community.
This possible certification problem has to be another blow for morale on all counts, which is terrible for everyone’s safety.
Things are horribly wrong in the police department.  The City officials in charge of oversight are informed of this and continue to let it ride—in $5,000,000 worth of our brand new cars.

CALEA CERTIFICATION SAID EVERYTHING WAS “WELL-MANAGED”
When will the results of this audit be complete?

Yes, there are many questions.
Just a few months ago, the City (that would be our money) spent $10,000 to pay CALEA for an on-site reaccreditation process, widely advertised as passed with flying colors.  CALEA is the Commission on Accreditation for Law Enforcement Agencies, and preaches “A team of CALEA-trained assessors visits the agency to determine compliance with standards, views agency operations, conducts a public information session, and reports its findings to the Commission for final determination of accreditation status.
Maintaining Compliance and Reaccreditation:   During its three-year accreditation award cycle, the agency must maintain compliance with applicable standards, keep its proofs of compliance up-to-date, and live by the letter and spirit of those standards. To retain its accredited status, the agency is required to submit to CALEA their appropriate accreditation continuation fees, as well as an annual report. Reaccreditation occurs at the end of the three years, following another successful on-site assessment and hearing before the Commission.
Does that mean that CALEA reviewed documentation for officers, and that everything was in order at the time of their February on-site review?  If so, what happened since then?  If not, was their certification completely worthless?
CMPD.org states an on-site CALEA visit in January 2011.  Note that the single date scheduled for Citizen Input was canceled due to inclement weather and not rescheduled.  It seems like for once every three years, the group might have stayed in town or come back an extra day. 
CMPD.org reports that CMPD received their reaccreditation in March 2011, in glowing terms: with CALEA finding CMPD to be “ ‘well equipped, well managed, and well respected’ within our community.”
I’m not sure how they made this determination without speaking to anyone in a forum with the community.  Maybe Rodney Monroe just told them.

PUBLIC RECORDS REQUESTS

Multiple attempts to confirm or refute information directly with the information officers were completely ignored, including a statement that silence on the matter would be considered acknowledgment from CMPD, but we’re just left to speculate how severe the problem and the consequences.  Below are some of the questions submitted beginning September 16th, continuing through October 10th, then forwarded to citynewswatch.
You can see that since at least September 16th, documented public records questions were asked about what’s been happening.  The response?  Nothing.  

We are owed an answer if these records disappearing was intentional or negligent, or some other offer or reason will be given.

I have contacted you because Captain Cunningham has not responded to the information request. It is inappropriate for you to say you will continue to support a city employee or employees to avoid following the law.

Please forward the e-mail or e-mails regarding the request for fingerprints that went out to police employees as specified below and give other information below. This holding back of public information must stop. This is public information, to be provided in a timely manner.

Please confirm if the state is or has conducted an investigation or audit of any type of the CMPD due to loss or destruction of personnel information. My information is that it has to do with missing fingerprint cards and possibly criminal background checks and other similar data.

What agency is conducting or has conducted the check and what records are involved?

LOCAL MEDIA REQUESTS

If every single station and newspaper asks for this information, what will happen?

1.    What initiated the agency to perform the “first-ever audit?”

2.    What specific records were found to be missing?

3.    When were officers notified of their records which are missing?

4.    How did these records become lost or missing?  If it hasn’t been determined yet, what steps are being taken to determine how this has occurred?  When was the last documented time these records were known to be accessed/known to be in their proper location?

5.    If social security information is involved, are officers receiving centralized assistance to notify credit bureaus to protect them personally?

6.    Is there any potential impact on DNC 2012 security?

7.    Is there any impact on careers here with the haunting lines that CMPD doesn’t know the status of certifications until the agency finishes their audit?

8.    What has taken place prior to this memo with officers allegedly forced to give their fingerprints again and why is the CMPD once again being permitted by City officials to refuse public information, as demonstrated by these emails including the City attorney in charge of Public Records information and the Mayor, Council, City Manager, and more?
